Terms of Service
Customer Acknowledgment
PEAK89 LLC, is a mobile detailing and auto washing service provider that primarily operates in SanPete County and surrounding areas. During the initial request and after receipt of services, the Client hereby acknowledges that they have read and fully understands the following terms and conditions, which shall be deemed binding as part of a mutual contract entered into voluntarily with PEAK89 Mobile Detailing. The Client further acknowledges that these terms and conditions are a material inducement for this agreement to receive said services.
The Terms and Conditions constitute the entire agreement between the Client and PEAK89 with respect to this website. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between the Client and PEAK89 with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by PEAK89. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
Scope & Pricing
Price estimates are based on industry averages according to the size and type of vehicle to be serviced. It is the sole responsibility of the Client to provide an accurate vehicle description and to what extent services may be required. This includes extreme conditions either interior or exterior or both, that may involve additional time spent and costs incurred to the Client.
If, at the commencement or during the course of performing a service, it becomes apparent that the actual cost of the service will exceed the quoted price provided by PEAK89, the Client will be made aware and thus given the opportunity to choose whether or not to proceed with the service.
“Add-On Services” are offered only as a pairing to a full interior or exterior service. PEAK89 does not perform individual Add-Ons or ale cart mobile services.
Service requests beyond 50 miles from Fairview UT, may incur a $1 per mile travel surcharge.
Services not covered:
• Removal or dismantling of seats – including seat tracks
• Bodily fluids – Contact Us for special requests and excess pricing
• Glove box – special request optional if completely emptied
• Spare tires and tire storage compartments
• Engine bay / under the hood
PEAK89 offers a “Routine Clean” discount program for monthly and quarterly scheduled appointments. Discount pricing is subject to vehicle size and interval of subscription and will be applied during check-out.
As of July,1 2024 the discount schedule is as follows:
• Clients who maintain a routine schedule at least once monthly will receive 30% off their entire service after two initial services performed at full price.
• Clients who maintain a routine schedule at least once quarterly will receive 20% off their entire service after two initial services performed at full price.
Payment Terms
The Client agrees to pay PEAK89 in full at the conclusion of the service event, unless otherwise agreed in advance and in writing. Client authorizes PEAK89 to charge the credit card on file if no cash or other form of payment is received. All outstanding invoices 14 days and over are subject to a late payment penalty of $40. PEAK89 accepts all major debit and credit cards, CashApp, Venmo and Cash as forms of payment.
Refunds
PEAK89 Service Technicians will invite the Client to perform a final walkthrough with them at the conclusion of a service. The Client is requested to identify, within reason, any touch-ups or additional work needed at this time. PEAK89 does not provide refunds on services performed. If, for any reason, the Client is unsatisfied with our services, they are invited to contact [email protected] to discuss a mutual resolve.
Appointments, Cancellations and Rescheduling
Whenever necessary, the client agrees to cancel or reschedule their booking at least 24 hours prior to their reserved appointment time. Failure to do so will result in the loss of the Clients $40 booking deposit and will not be applied to future bookings.
Service Technicians shall make every effort to keep the Client informed of their estimated time of arrival and are given +/- 1 hour to adjust to unplanned variables throughout the course of their day. PEAK89 reserves the right to refuse additional service requests while on site so as not to disrupt other client reservations, though may be scheduled for a later date/time.
If after 15 minutes the Service Technician is unable to make contact with the Client and the vehicle is not present or remains inaccessible at the address provided, the appointment will be considered a “No-Show” and the booking deposit will be credited to PEAK89.
Risk of Loss
PEAK89 is not responsible for any valuables left in the vehicle before, during, or after a service. Clients are responsible for removing all valuables and personal belongings before a service is performed. Service Technicians will place trash and all other items collected from the vehicle into a plastic bag and leave it on the floor of a passenger seat.
Limitation of Liability
IN NO EVENT SHALL PEAK89 BE LIABLE FOR ANY LOSS, LIABILITY, DAMAGE OR EXPENSE. CUSTOMER EXPRESSLY WAIVES ANY AND ALL RIGHTS TO CLAIM ANY ADDITIONAL DAMAGES, INCLUDING BUT NOT LIMITED TO: ANY LOSS OF USE OR PROFITS, LOSS OF BUSINESS, LOSS OF BUSINESS REPUTATION, EXPENSES OR COSTS ARISING FROM OR ALLEGED TO ARISE FROM BUSINESS INTERRUPTION, DAMAGE TO REAL OR PERSONAL PROPERTY, AND FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR SPECIAL DAMAGES CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE, TORT, STRICT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY OR OTHER BREACH OF DUTY BY PEAK89.
Governing Law
In the event of litigation both parties agree that the Law of the State of business registration of PEAK89 shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by juryClass Action Waiver.
TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOMER EXPRESSLY WAIVES ANY AND ALL RIGHTS TO MAKE A CLAIM FOR DAMAGES AS A CLASS MEMBER IN ANY CLASS ACTION OR AS PART OF A PLAINTIFF GROUP.
Warranties
The information and content on this server is provided "as is" with no warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any warranty that is provided in connection with any of the products and services described on this Web site is provided by the advertiser or manufacturer only, and not by PEAK89.
